1. About These Terms
These Terms of Service ("Terms") govern your use of ManageMySite's website at managemysite.co and the services we provide. By engaging ManageMySite for any service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you confirm you have authority to do so.
2. Our Services
ManageMySite provides website operations services including but not limited to: site management retainers, SEO architecture, performance optimisation, CMS restructuring, website builds, migrations, and one-time technical projects. The specific scope of work is agreed in writing prior to commencement.
Services are delivered on the platforms we support: WordPress, Shopify, Framer, and Webflow. We do not guarantee results that depend on third-party platforms, algorithms, or factors outside our control.
3. Retainer Plans
Our managed service retainers (Foundation, Growth, Scale) operate on a monthly rolling basis. Payment is due at the start of each billing period. Annual billing is available at a 15% discount and is non-refundable after the first 30 days.
- Monthly plans require 30 days written notice to cancel
- Annual plans are billed upfront and non-refundable after the 30-day cooling-off period
- Unused change requests do not roll over between billing periods
- We reserve the right to adjust pricing with 60 days notice to existing clients
4. One-Time Projects
Project-based work (site builds, migrations, audits, sprints) is scoped and agreed in a separate written statement of work. A 50% deposit is required to begin. The remaining balance is due upon completion. Projects are delivered within the agreed timeline unless delayed by client feedback or access issues.
5. Free Audit
The free audit is a genuine technical review, not a sales call disguised as one. The written report is yours to keep regardless of whether you become a client. We aim to deliver it within 48 hours of the audit call. The audit is limited to one per company.
6. Client Responsibilities
To deliver services effectively, we require:
- Timely access to the platforms, tools, and credentials needed for your site
- Reasonable responsiveness to questions and requests for approvals
- Accurate information about your site, goals, and any known issues
Delays caused by client unresponsiveness may affect delivery timelines and do not entitle clients to refunds or credits.
7. Intellectual Property
All work product created by ManageMySite during the engagement becomes your property upon full payment. We retain the right to reference the engagement in our portfolio unless you request otherwise in writing. Any third-party tools, themes, or plugins remain subject to their respective licences.
8. Confidentiality
Both parties agree to keep confidential any non-public information shared during the engagement, including business strategies, traffic data, conversion rates, and technical architecture. This obligation survives termination of the agreement.
9. Limitation of Liability
ManageMySite's total liability in any calendar month shall not exceed the fees paid in that month. We are not liable for indirect, consequential, or incidental damages including loss of revenue, loss of data, or reputational harm. We are not responsible for third-party platform outages, algorithm changes, or factors outside our direct control.
10. Warranties and Disclaimers
We will perform services with reasonable skill and care. We do not guarantee specific search ranking positions, conversion rates, or traffic outcomes, as these depend on factors beyond our control. Any projections shared are estimates based on industry data, not guarantees.
11. Termination
Either party may terminate a monthly retainer with 30 days written notice to info@managemysite.co. ManageMySite reserves the right to terminate immediately for non-payment, abusive conduct, or requests to perform illegal or unethical work. Upon termination, we will hand over all credentials, files, and documentation within 5 business days.
12. Governing Law
These Terms are governed by the laws of the State of Colorado, United States. Clients based in the United Kingdom may alternatively elect to have disputes governed by English law. Any disputes not resolved by negotiation will be submitted to binding arbitration before litigation is pursued.
13. Changes to These Terms
We may update these Terms from time to time. Existing clients will be notified by email with at least 30 days notice of material changes. Continued use of our services after the notice period constitutes acceptance.
